The appellant husband has challenged the judgment / order dated 22.6.2015 in Petition No. A 210/2013 passed by the Family Court, Nashik granting decree of restitution of conjugal rights to the wife. However, subsequently by the order dated 25.1.2019 passed in F-381/2018, the Family Court, Nasik has passed decree of divorce under Section 13B of the Hindu Marriage Act and has granted divorce to the parties by mutual consent. A copy of the said order is produced by the learned counsel for the appellant. The same is taken on record and marked "X" for identification.

2. In view of this subsequent development, nothing survives in the present Family Court Appeal and the same is disposed of as having rendered infructous.
