Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail in connection with C.R.No. 157 of 2023 registered with Nalasopara Police Station for the offences punishable under sections 406 and 420 of the Indian Penal Code, 1860.

This Court has granted interim protection on 30th August 2023 ascribing reasons.

Learned APP, on instructions of the Investigating Offcer, who is present in Court, informs the Court that in terms of the directions contained in the order dated 30th August 2023, the applicant had appeared before the Investigating Offcer. 5.

For the reasons assigned in the order dated 30th August 2023 and having regard to the nature of the accusation, further custodial interrogation of the applicant does not seem to be warranted. The applicant appears to have roots in Society. The possibility of tampering with the prosecution evidence and/or fleeing away from justice appears to be remote. I am, therefore, impelled to make the order dated 30th August 2023 absolute. 6.

Hence, the following order :

O R D E R

(i) The order dated 30th August 2023 is made absolute on the terms and conditions incorporated therein.

(ii) The applicant shall regularly attend the proceedings before the jurisdictional Court.

(iii) The Application is disposed.
