It appears that both the Petitioner and the Respondent No.2 are senior citizens and because of some domestic difference, the police complaint came to be lodged.

The Respondent No.2 has tendered a separate Affidavit accordingly and pointed out that she does not want to continue the prosecution. The Respondent No.2 states that she has been cohabiting with the Petitioner even after the incident. 4.

Accepting the oral request made, we make Rule absolute in terms of prayer clause (a).

We also clarify that request for release of revolver in the custody of the Respondent No.1 shall be dealt with by the Respondent No.1 as per law.
