After this Petition was heard for some time and considering the provisions of Section 85 of the Finance Act, 1994 which provides for an appeal against the impugned order passed by the Office of the Commissioner of CGST and Central Excise Commissionerate, Belapur, Navi Mumbai as impugned in the present petition, petitioner seeks leave to withdraw the present petition with liberty to approach the appropriate Appellate Authority.

Allowed to be withdrawn with liberty as prayed for. All contentions of the parties are expressly kept open. 3.
