On 23/09/2022, the applicant was directed not to be arrested in the subject C.R., which invoke Sections 188, 272, 273, 328 read with Section 34 of IPC alongwith the relevant Section of Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011.

Learned A.P.P. makes a categorical statement that the applicant has reported to the police station and his custodial interrogation is not necessary.

In the wake of the above statement, the applicant deserve protection from arrest.

Hence, the following order.

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.I193 of 2022 registered with Kongaon Police Station, City Bhiwandi, Dist.Thane, applicant-Aashitosh Bhatiya shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount. (c) The applicant shall report to the concerned police station on frst Monday of every trimester between 3.00 p.m. to 5.00 p..m., till framing of charge. (d) The applicant shall furnish his contact number and residential address to the Investigating Offcer and shall keep him updated, in case there is any change. (e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Offcer and shall not tamper with evidence.
