1] This is an application for interim protection for pre-arrest bail in CR No.275 of 2017 registered with Chturshrunghi Police Station, Pune. 2] It is submitted that, the Anticipatory Bail Application No.1768 of 2017 is pending for final adjudication on the file of District Judge-1 and additional Sessions Judge, Pune. That from 12.7.2017 under the oral directions of the concerned Court, the applicants were protected, however, after change in the Court i.e. after change in the concerned Judge presiding over the said Court, new learned Judge did not extend the said protection. That the application for interim relief is also not considered till date. It is further submitted that, the Anticipatory Bail Application No.1768 of 2017 is now scheduled for hearing on 18.9.2017 before the concerned Court. i.e. District Judge-1 And Additional Sessions Judge, Pune.
Dond 2/2 ABA.1609-2017.sxw 3] In view of the above, without going into the merits of the application, the applicants are granted interim protection till their application is finally decided by the concerned Court on the following conditions: () In the event of the arrest, the applicants be enlarged on bail on furnishing P.R. Bond in the sum of Rs.25,000/- each with one or two sureties in the like amount.
(i) The applicants shall report to the office of E.O.W.,Crime Branch, Pune on 16th September 2017 between 10.00 a.m. to 12.00 noon. (ii) The District Judge-1 And Additional Sessions Judge, Pune is hereby requested to make an endevour to decide the application preferred by the applicants bearing No.1768 of 2017 preferably on 18.9.2017 or as early as possible.
(iii) It is needless to mention that, the learned Additional Sessions Judge, Pune to decide the said application on its own merits uninfluenced by the interim relief granted by this Court.
(iv) It is made clear that the applicants shall not seek any adjournment before the concerned Court.
