Learned counsel for the petitioner submitted that the petition was filed seeking quashment of the proceedings of the criminal case No.1328/MISC/2018 filed at the instance of respondent No.2 against the petitioner for the offences punishable under Sections 420, 406, 465, 193 read with Section 34 of the Indian Penal Code, 1860, and pending on the file of learned Metropolitan Magistrate, 25th Court at Mazgaon, Mumbai. During the pendency of the petition, on submission of the charge-sheet, charges were framed and the trial was proceeded and the trial concluded in acquittal of the petitioner, as such, the petition has been rendered infructuous. Accordingly, learned counsel for the petitioner has prayed for withdrawal of the petition. At his request, the petition is allowed to withdrawn and is disposed of as such.
