DATE: FEBRUARY 01, 2022 P.C.:- 1] Admittedly, proceedings being Hindu Marriage Petition No.78 of 2021 under Section 9 of the Hindu Marriage Act for restitution of conjugal rights and the proceedings being Misc. Criminal Application No.36 of 2021 under the provisions of Domestic Violence Act are pending in the respective Court at Malshiras, Solapur. Non-applicant is already attending the said proceedings.

2] Considering the distance between Kalyan and Malshiras and the fact that non-applicant is not willing to bear sufficient travel and out of pocket expenses, case of hardship is made out in favour of the Applicant-wife.

47 MCA-209-21.doc 3] Application is allowed in terms of prayer clause (a) which reads as under:- "(a) This Hon'ble Court be pleased to transfer the Petition bearing H.M.P. No.828 of 2021 filed by the Respondent which is pending before the Court of the Civil Judge, Senior Division, Kalyan, Thane to the Court of the Civil Judge, Senior Division, Malshiras, Solapur;"

4] The Court before whom respective proceedings are pending shall ensure that as far as possible, all the three matters be posted on very same day so as to be convenient to the parties to attend the same. ( NITIN W. SAMBRE, J. ) 2/2
