The learned counsel further submits that the applicant would surrender before the concerned Magistrate on or before 24.1.2018. In view of this, the applicant stands protected till 5 p.m. on 24.1.2018. 3.

The learned Magistrate shall not be influenced by the withdrawal of this application under Section 438 of Cr.P.C. and shall decide the application on its own merits.
