By this application, the applicant/convicted accused is seeking permission to travel abroad for a period of 3 months st October 2019 to 31 st December 2019 in order to starting from 1 perform Umra at Saudi Arabia.

Heard both the sides. Learned counsel for the applicant has pointed out that on three occasions, in past, this Court had passed orders permitting applicant to travel abroad. He submitted that, Chitra Sonawane 1/4

vide order dated 21.8.2015 (Coram:Abhay Thipsay,J), vide order dated 14.1.2019 (Coram:Smt.Sadhana S. Jadhav,J) and vide order dated 28.3.2019 (Coram:Revati Mohite Dere,J) applicant is permitted to travel abroad.

Applicant is convicted of offence punishable u/s 307 r/w 34 and 341 r/w 34 of I.P.C. by learned Assistant Sessions Judge, Bombay and sentence imposed on him has been suspended by this Court.

In past, on three occasions, the coordinate Benches of this Court have permitted applicant to travel abroad. Copies of two such orders are placed on record by the applicant. In this view of the matter, I see no reason to deny similar relief to the applicant and therefore, the order.

st a) Applicant is permitted to travel Saudi Arabia from 1 st December 2019 to perform Umra at October 2019 to 31 Saudi Arabia.

b) The applicant shall furnish additional security in the sum of Rs.50,000/- for his appearance before this Court by furnishing a surety in the said amount and/or cash deposit of the said amount by executing an appropriate bond.

c) The applicant shall submit his itinerary before the investigating agency. The applicant shall also give the details of his travel and residence in Saudi Arabia. d) The applicant shall give a copy of the ticket as well as the copy of the passport to the investigating agency. The applicant shall give his telephone numbers and cell phone numbers for the purpose of communication. e)The applicant shall furnish a copy of all the above documents to this Court also before travelling. The applicant shall mark his presence before the Sessions th January 2020.
