Mr. Yagnik, learned APP, having taken instructions, stated that the petitioner's complaint was enquired into and a conclusion is arrived at that the allegations in the complaint disclose commission of non-cognizable offence. In support of his statement, he has placed on record the report dated 28th November, 2016 of the Assistant Commissioner of Police, Aale Phata Police Station. 3.

In the above circumstances, we are not inclined to entertain the petition, especially when the petitioner has an alternative efficacious remedy of approaching a magistrate by way of private complaint.
