Heard learned Counsel for the applicant on this application for condonation of delay of 28 days in filing the application for leave to file appeal, challenging the acquittal of the respondent No.2 who is proprietor, in the matter of offence punishable under Section 138 of Negotiable Instruments Act. The respondent No.2 is served as per the office remark. None present for respondent No.2. For the reasons mentioned in the application, delay is condoned. Application is allowed.
