After hearing in the first half, the matter was kept back. In the second half, learned APP has produced, for our perusal, photocopy of injury report dated 10/10/2017 issued by St. Georges Hospital, Mumbai. It is taken on record and marked 'X' for identification. This report shows simple injury to the Petitioner No.1. URS 1 of 2

Respondents have informed him that the offence reported is non-cognizable in nature.

Insofar as the grievance in relation to the incident dated 06/09/2017 is concerned, it appears that the Petitioners do not have anything in writing to support the case. The grievance finds mention in black and white for the first time on 08/09/2017 when the present petition has been signed. The assault on the Petitioner No.1 has taken place on 06/09/2017.

Hence, we are not inclined to take cognizance of the grievance in extraordinary jurisdiction. With liberty to the Petitioners to take such other steps as are available in law, we dispose of the present petition.
