The above Civil Application has been filed for extension of time to comply with the directions as contained in paragraph 6 of the order dated 12/02/2015 passed in the above Petition. The direction is to the effect that the Applicant-Respondent No.1, who is the original Plaintiff to correct the valuation of the suit and to accordingly pay court fees within four weeks from the date of the said order. The said order was challenged in the Apex Court by way of SLP (Civil) No.15643 of 2015 the said SLP was dismissed by the Apex Court on 31/08/2015. It is thereafter that the instant application has been filed.

In my view, since the SLP filed by the Applicant has been dismissed on 31/08/2015 by the Apex Court, it would be just and proper to grant the Applicant four weeks time to comply with the direction in respect of the valuation as regards prayer clauses (AA) and (AB) in terms of Section 6(iv) (ha) of the Bombay Court Fees Act and pays the court fees accordingly. The above Civil Application is accordingly disposed of. [R.M.SAVANT, J]
