The appellant has sworn an affidavit which is taken on record today. By this affidavit the appellant, who is original respondent in Motor Accident Claims Petition No.48 of 2008 deposed that, there was a compromise arrived at between him and the respondent/original claimant in an execution proceeding no.2 of 2013 which was filed by the respondent in Motor Accident Claims Petition No.48 of 2008. Pursuant to the said compromise, it is deposed in the affidavit that, the entire decreetal amount has been paid to the respondent on 17 th March 2019.

As such, the appellant does not wish to prosecute the appeal further and seeks to withdrawal of the same.
