When asked to the learned A.P.P., whether notice under Section 41A of Cr.P.C. was issued to the applicant, considering that the subject C.R. invoke Sections 406 and 420 of IPC, which are punishable for less than seven years, she answered in affrmative. However, she states that the notice could not be served upon the applicant, since he was not found at his residential address.

Learned counsel Mr.Khandeparkar states that, since a notice has been issued, he shall report to the Investigating Offcer within a period of days from today.

2/2 914 ABA-2624-22.doc Upon his appearance, Investigating Offcer shall follow the procedure prescribed under Section 41A and if he is desirous of effecting the arrest of the applicant, he shall record his reasons in writing for doing so and shall issue 2 hours notice to the applicant, before effecting his arrest. 3.

With the aforesaid direction, the application stands disposed off.
