DATE : 9th AUGUST 2019.
P.C. :
The appellants are accused in Crime No. 570 of 2018 registered with Karmala Police Station, Solapur District, for the alleged offences under Sections 324, 327, 143, 147, 148, 149 and 109 of IPC, besides Sections 3 (i)(r)(s), and 3 (2) (va) of 1/2
Seema 10. Cri. Appeal 1081 of 2018.odt the Scheduled Castes and Scheduled Tribes Act.
2. Initially, the appellants applied under Section 438 of Cr. PC for an anticipatory bail before the Sessions Court, Barshi. That rejected, they filed this Criminal Appeal under Section 14 A of the Act. This Court on 12.09.2018 granted an interim bail to the appellants and that has continued till date.
3. Despite service of notice, the respondent-victim has not chosen to appear. The appellant's counsel informs the Court that the police have completed the investigation and filed the Charge-sheet. According to him, nothing further survives in this Appeal. So he wants this Court to make this interim protection absolute. The learned APP, on instructions, confirms that the police have already filed the Charge-sheet.
Under these circumstances, I make the order dated 12.09.2018 absolute subject to the conditions imposed in that order. I, therefore, dispose of Criminal Appeal No. 1081 of 2018 and Criminal Appeal No. 1080 of 2018.
