This an application for suspension of sentence and for releasing applicant/accused on bail during pendency of the appeal filed by him.

The applicant/accused is convicted of offences punishable under Sections 354-D of the Indian Penal Code. He is sentenced to suffer rigorous imprisonment for six months apart from payment of fine of Rs.1000/- and in default to suffer rigorous imprisonment for one month.

The learned Additional Public Prosecutor opposed the application.

Short sentence of imprisonment for six months is imposed on the applicant/accused and the appeal filed by him may not be heard within such a period. The applicant/accused was on bail during pendency of trial and he has not mis-used his liberty. Hence the order;

:: ORDER ::

(i) Substantive sentence of imprisonment imposed on the applicant/accused is suspended and he is directed to be released on bail on his executing P.R. Bond in the sum of Rs.15,000/- and on his furnishing one or more surety in the like amount.

(ii) As a condition of this order, the applicant/accused should not contact the victim child or her relatives in any manner and he should not commit similar offences in future.
