Both the applicants were apprehending arrest in C.R. No.185 of 2018 registered with Chaturshrungi Police Station, Pune for the offence punishable under Sections 406, 420 of Indian Penal Code (for short "IPC") and Sections 43 and 66 of the Information Technology Act (for short "IT Act"). 2.
The applicants were granted interim protection by this Court vide order dated 23.08.2019. The case of the complainant is that the applicant in Anticipatory Bail Application No.1853 of 2019 was a partner in the partnership firm and the applicant in Anticipatory Bail Application No.1854 of 2019 was working as IT vendor in the partnership firm. After working for about 3 years in the firm, both of them left the firm. The first applicant formed his own company in the name of his wife and both the applicants had used the data of the clients of the complainant's partnership firm and had caused loss to them. They have unauthorizedly accessed the data of complainant's firm.

Pursuant to the interim protection granted by this Court, vide order dated 23.08.2019, the interim order was executed. Learned APP submitted report from the concerned police station. Report dated 02.09.2021 indicates that the applicants were arrested and released on bail on 15.11.2019. Charge-sheet was filed against them in the court of learned JMFC, Court No.9, Pune. Report is taken on record. In the light of aforesaid report and factual aspects of these matters, the question of subjecting the applicants to custodial interrogation at this stage does not arise. Hence, I pass following order:-
ORDER
(i) Anticipatory Bail Application Nos. 1853 of 2019 and 1854 of 2019 are allowed.
(ii) The interim protection granted vide order dated 23.08.2019 is confirmed.
(iii) In the event of arrest in connection with C.R. No.185 of 2019 registered with Chaturshrungi Police Station, Pune, the applicants are directed to be released on bail on P.R. bond in the sum of Rs. 25,000/- each with one or two sureties in the like amount;
(iv) Applications as well as Interim applications stand disposed of.
