1] Applicant is seeking pre-arrest bail in C.R. No. 411/2021 registered with Bhiwandi Taluka Police Station for Offences punishable under Sections 353, 323, 504, 506 r/w 34 of the Indian Penal Code.

2] Prosecution story is, complainant alongwith other employees of Torrent power electric company, who were having distribution and collection rights towards electric energy consumed by beneficiaries 1/3

were obstructed and assaulted by the applicant, who is an elected member of Village Panchayat.

3] The submissions of learned counsel for the applicant are, applicant is falsely implicated in the crime, particularly in the background of the fact that in the capacity of elected representative, he has tried to mediate in between the complainant and the villagers who were served with exorbitant energy bills. 4] Learned APP opposed the prayer for bail.

5] With the assistance, I have perused the investigation papers. The employees of company who were alleged to have been assaulted by the applicant were subjected to medical examination. Statement of eye witnesses and the medical evidence primarily depicts prima facie involvement of the applicant in the crime in question. 6] Applicant, an elected representative is required to behave in more responsible manner in situation like the one and must respect 2/3

the law and order.

7] Prima facie involvement of the applicant could be inferred. That being so, no case for bail is made out. Application stands rejected. [NITIN W. SAMBRE, J.] 3/3
