The consent terms are taken on record and marked as "X" for purpose of identification. 2] First Appeal is disposed of in terms of the consent terms. 3] In view of disposal of first appeal, pending Civil Application and Cross Objection, if any, do not survive and the same are also disposed of.

4] The appellant shall be entitled to refund of court fees as per rules.
