Respondent-Original Claimant, seeks leave to withdraw the amount of compensation deposited by the appellant, pursuant to th January, 2013 passed by the the judgment and order dated 19 Commissioner for Workmen's Compensation under Employees' Compensation Act, 1923. In terms of the said judgment, appellantInsurance Company deposited Rs.5,49,470/-, out of which claimant had withdrawn Rs.2,50,000/-. This application seeks leave to Shivgan 1/2

33-IA-1211-2022.odt withdraw balance amount of compensation of Rs.2,99,470/-. Heard learned counsel for the parties.

In consideration of the facts of the case and in view of the averments in the application, applicant is permitted to withdraw Rs.1,50,000/- against the security to the satisfaction of the Commissioner for Workmen's Compensation. Application is allowed and disposed of in aforesaid terms.

List the First Appeal for final hearing in a week th July, 2022.
