The petitioner being the complainant is entitled to challenge the acquittal by way of appeal. In that view of the matter, the advocate for the petitioner on instruction seeks permission to withdraw the petition with liberty to file criminal appeal against of the acquittal dated 9th June, 2022.

While considering delay in filing the appeal, pendency of present proceeding shall be considered as bona fide. 3.

The writ petition is dismissed as withdrawn with liberty as prayed for. No costs.
