This application is filed under Section 24 of the Civil Procedure Code by the applicant/ wife for transfer of the Marriage Petition No. A-998 of 2016 filed by the respondent/ husband for divorce under Section 13 (1) (ia) of the Hindu Marriage Act, which is pending before the Family Court, Bandra, Mumbai, to be transferred to the Court of Civil Judge, Senior Division, Pune, where the Marriage Petition No. 409 of 2016 for restitution of conjugal rights under Section 9 of the Hindu Marriage Act filed by the applicant/wife is pending. 1 / 2

A report dated 13th April, 2018 received from the learned 14th Joint Civil Judge, Senior Division, Pune informs that video conferencing facility is available with the establishment of the Hon'ble District Court, Pune and it is practical and feasible to record the evidence and conduct the trial by video conferencing. 3.

In view of the above report, it is not required to transfer the Marriage Petition No. A-998 of 2016 from the Family Court, Bandra, Mumbai to the Court of Civil Judge, Senior Division, Pune. The Family Court, Bandra, Mumbai will acquire the presence of the applicant/ wife through video conferencing.
