Mr. Prashant S. Hagare, learned counsel appearing for the Appellant states that, the parties have settled the dispute.

He states that, compromise pursis has been fled in Criminal Application No.44 of 2019 before the Court of J.M.F.C. Indapur, Taluka - Indapur, District - Pune. He states that in view of said compromise, the Appellant has instructed him to withdraw the Second Appeal.

Accordingly, the Second Appeal is allowed to be withdrawn and dismissed as such.

In view of dismissal of the Second Appeal, nothing survives in the Civil Application No.857 of 2007 and the same is also disposed of.
