Heard Mr. Deshmukh, learned counsel for the petitioner. Mr Deshmukh submitted that the present petition was on the issue of election of respondent No.5-Society declared on 10th November, 2021. But recently, the petitioner came across a communication issued at the instance of the Secretary, State Co-operative Election Commission, Maharashtra State, Pune, whereby the election programme which was to held as per the election schedule from 10th November, 2021 to 22nd November, 2021, itself is cancelled. It is further stated in the communication that fresh election programme would be published by the authority by issuing a separate order. A copy of the said communication/letter dated 22nd November, 2021 is taken on record and marked "X".

In view of the said communication, learned counsel for the petitioner submits that the petitioner is not desirous to prosecute the petition and prayed for withdrawal of the petition.
