This civil writ petition takes exception to an order passed by the appellate bench of Small Causes Court at Mumbai on a stay application in a review petition. In the meantime, during the pendency of the present writ petition, the review petition itself has been disposed of by the appellate bench of the Court. The Petitioner has challenged that order before this Court in a writ petition, namely, Writ Petition (Stamp) No.26172 of 2019.

In the premises, this writ petition is disposed of by requiring the Petitioner to deposit a sum of Rs.4,40,000/- before 14 October 2019 and produce evidence before the Court of having done so. Subject to the Petitioner depositing the amount, the execution of the decree of eviction passed by the trial court against the Petitioner shall remain stayed
