The petition is filed for quashing the proceedings of RCC No.4140 of 2016 pending on the file of the 7th Joint Civil Judge, Junior Division and JMFC at Pune arising out of registration of FIR No.45 of 2015 with Koregaon Park Police Station, Pune. 2.

The petitioner-in-person after arguing for some time, stated that he has already filed an application for discharge before the Trial Court and he has approached this Court since the said discharge application is not disposed off. He stated that, if this Court directs the learned Trial Judge to decide his application, he will not press for the relief claimed in this petition. The statement is accepted. Shubhada S Kadam 1/2

In the light of the above, we deem it convenient to dispose off this petition by directing the 7th Joint Civil Judge, Junior Division and JMFC at Pune to dispose off the petitioner's application for discharge filed in RCC No.4140 of 2016 as expeditiously as possible and preferably within a period of three months from the date of receipt of this order. Ordered accordingly.

It is made clear that we have not gone into the merits of the matter and all rights and contentions of the respective parties are kept expressly open. The learned Judge shall dispose of the petitioner's discharge application independently on its own merits and in accordance with law.

The writ petition stands disposed off.
