The applicants are apprehending arrest in CR NO.49/2015 registered with Rabodi Police Station, Thane under section 498(A), 313, 316 and 406 read with 34 of the I.P.C. The record discloses that the learned counsel appearing for the applicants had sought leave to delete the names of the applicants 1,2 and 4 who were husband, mother-in-law and sister-in-law of the complainant. The present application is therefore, being pursued by applicant No.3

2 /2 ABA-1446--2015 father-in law of the complainant. The FIR dated 4.2.2015 has been lodged by Smt. Sahenaj Shaikh- daughter in law of the present applicant for the offences mentioned herein above. A bare perusal of the FIR discloses that the role attributed to the present applicant i.e. father-in law of the complainant with other accused persons is that they demanded money and/ or dowry from the complainant. Apart from the aforesaid allegation, there is no other other overt act attributed to the present applicant in the present crime. The learned APP fairly conceded the said fact. In view of the above, the interim protection granted by this court to the applicant by order dated 17.10.2015 is hereby confirmed. Application is allowed in the aforesaid terms.
