This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.36 of 2021 registered at Marketyard Police Station, Pune for the ofences punishable under Sections 409, 417, 419, 420, 403, 423, 467, 471, 167and 168 read with 34 of the Indian Penal Code and Sections 65, 66, 66(C) and 66(D) of the Information Technology Act.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

According to the prosecution, the present applicant and other co-accused got prepared forged documents and on the basis of said documents, they got transferred an amount of Rs.36,58,210/- from the bank account of the complainant through 1/2

7-ba-2834-22.doc RTGS. It appears that the Investigating Ofcer had issued letters to the Banks to freeze the bank accounts where the amount was transferred and pursuant to it an amount of Rs.16,37,417/- is freezed.

The applicant is in jail for about 1 year. There are no other criminal antecedents. Considering these facts, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R. No. 36 of 2021 registered at Marketyard Police Station, Pune for the ofences punishable under Sections 409, 417, 419, 420, 403, 423, 467, 471, 167and 168 read with 34 of the Indian Penal Code and Sections 65, 66, 66(C) and 66(D) of the Information Technology Act on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount, subject to deposit of Rs.75,000/- by the applicant before the Trial Court. C] The applicant shall attend the concerned police station once in a month, i.e., on Saturday between 11:00 a.m. to 2:00 p.m. till conclusion of trial.
