The application is moved for condonation of delay of 353 days. The learned counsel for the Respondents are present. It is submitted that in fact there is no delay because Writ Petition was earlier filed and thereafter as it was not maintainable the First Appeal was filed.

In view of these reasons and uncontroverted submissions, the delay is condoned. Hence, the civil application is allowed.
