The learned counsel for the petitioner submits that respondent No.1 happens to be the real brother of the petitioner. That respondent No.1 is no more. It is also submitted that responder No.1 was the only contesting party in Special Civil Suit No.1082 of 2005 pending before the Civil Judge, Senior Division, Pune. The suit was for partition and separate possession. In view of this, the prayers in the petition have become infructuous. It is made clear that this Court has not gone into the merits of the matter. The Petition is accordingly disposed of. Rule is discharged. [SMT. SADHANA S.JADHAV, J.]
