IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.529 OF 2017 Shah Jahan Hayachand Desai & Anr.

.. Petitioners V/s.

The State of Maharashtra & Ors.

.. Respondents ......

Mr. Chetan G. Patil, Advocate for the Petitioners. Ms. Nisha Mehra, AGP for Respondent - State.

......

CORAM : SHANTANU S. KEMKAR AND PRAKASH D. NAIK, JJ.

DATED :

JANUARY 17, 2017.

P.C. :

Not on Board. Production of papers are allowed at 3.00 p.m.

The grievance of the petitioners is that the complaint lodged by the petitioners in respect of non furnishing of account of expenses within time before the 3rd respondent though has been heard and reserved for orders on 7th April, 2016, but till date no decision has been taken by the 3rd respondent on the said complaint as yet. In the circumstances, a prayer has been made to dispose of the petition by directing the 3rd respondent to decide the petitioners complaint which has been closed for orders as per Roznama (Exhibit-F) dated 7th April, 2016.

rpa 2/2 wp-529-17.doc Keeping in view the aforesaid limited prayer, the petition is disposed of by directing 3rd respondent to decide the said complaint in accordance with law as expeditiously as possible and in any case not later than six weeks from the date of receipt of copy of this order. Needless to say that we are not commenting upon the merits of the matter.
