Heard learned counsel for the parties.

This Civil Application is moved seeking extension of one week's time to pay the costs of Rs.10,000/- to the respondents or their advocate. It is submitted that, as per the order passed by this Court on 7th September 2016, the applicant-appellant was directed to pay the costs of Rs.10,000/- to the respondents within one week. Accordingly, the applicant-appellant has sent the cheque to the respondents on their address given in the Court. However, it is submitted that the said cheque is not received by the respondents.

Today, the learned counsel for the applicant-appellant has brought the cheque with him and he hands over the same to the learned counsel for the respondents, who accepts the same.

In view thereof, there remains no dispute on this score and as a result of acceptance of the amount of costs, the time to execute fresh agency agreement, which was granted earlier, is extended for one week more from today.

As regards the execution of fresh agency agreement, on the request of learned counsel for the respondents, learned counsel for the applicant-appellant undertakes to give current residential address of Canada of the applicant-appellant and his power of attorney to the respondents and so far as other aspect relating to whether applicantappellant can keep or induct any care-taker in the suit premises, both the parties assured the Court that they will sort out the matter amicably. 6.
