The applicant was admitted to protection from arrest on 29/04/2022 in ABA No.519 of 2022, which was filed before the bench at Aurangabad. After the offence was registered initially with Kalmnuri Police Station Dist. Hingoli the investigation was transferred to Murbad Police Station, Thane and therefore the matter was transferred to Principle seat and the ABA is re-numbered as 2629 of 2022.

I have heard the learned APP and perused the order dated 29/04/2022, which specifically refer to the direction issued by the Ashish Mhaske

2/2 905ABA 2629.22.doc Hon'ble Apex Court in case of Arnesh Kumar v. State of Bihar, (2014) 8 SCC 273, and the Officer is reminded to follow the directions and even an anguish is expressed that the Sessions Judge as well as the Additional Sessions Judge do not resort to the said position of law. The protection was granted, and it was continued from time to time. In absence of request by the Investigating Officer that the custodial interrogation of the applicant is warranted, the order dated 29/04/2022 is made absolute.
