Heard learned counsel for the applicant. The application is opposed by the learned counsel appearing for the writ petitioner. We find that in the writ petition a relief has been claimed in respect of the structures on the land claimed by the applicant. Moreover, the prayer of the applicant for regularization is being considered by the third respondent- MMRDA as disclosed in the affidavit filed today. Therefore, the applicant is a proper party to the writ petition. Accordingly, application is allowed in terms of prayer clause (a).
