By this petition under Article 227 of the Constitution of India, the Petitioner challenges the order dated 19.9.2016 passed by Additional District Collector (Encroachment/Removal) allowing respondent no.3's application for intervening in the matter.

Respondent no.3 Mr.Sayed Haidar Imam, party in person appeared. He submits that Appeal No.464 of 2016 in which the impugned order was passed on 19.9.2016, was finally disposed of by the authority by order dated 23.9.2016. He placed on Mohite 1/2

pr21 wp11220-16 record photocopy of the said order. Same is taken on record and marked 'X' for identification.

In view of subsequent development, the learned counsel for the petitioner after taking instruction from his client who is present in court makes a statement that petitioner may be permitted to withdraw the present petition. To that effect, he has given in writing on Farad. Same is taken on record and marked 'X-1' for identification. Same is allowed.

Writ Petition stands dismissed as withdrawn. No order as to costs.
