CORAM :
A.S. OKA AND M.S. SONAK, JJ.
DATE :
3rd SEPTEMBER 2018.
P.C.:
1] The learned counsel appearing for the petitioners tenders across the bar a copy of the release order dated 31st August 2018. He states that in absence of the petitioners, copies of the said order were dropped at the respective residences of the petitioners in the night of 31st August 2018. He pointed out that this was done after the papers of these petitions were produced before this Court on the evening of 31st August 2018.
DSS 2/2 3-6-wp-9835-9838-18.doc 2] We find that the impugned order rejects the prayer for ad-interim relief of stay of the order dated 21st August 2018 of transfer/change of headquarter of the petitioners. If the petitioners make out a case for grant of stay, the petitioners will have to be brought back and posted at the headquarters where they were posted under the orders of suspension. We are sure that the Tribunal will hear the prayer for interim relief on 24th September 2018 when the Original Applications are fixed for hearing as to the interim relief.
3] In view of what is observed above, the learned counsel appearing for the petitioners, on instructions, seeks leave to withdraw the petitions. 4] Subject to what is observed above, the petitions are disposed of as withdrawn. We make it clear that the prayer for interim relief made by the petitioners will be decided on its own merits. (M. S. SONAK, J.) (A.S.OKA, J.) by Dinesh Sadanand Sherla Date:
