This Revision Application challenges interim order dated 02.07.2014 passed by the learned Sessions Judge, Mumbai, directing respondent-husband to pay Rs.4,000/- per month towards maintenance. The learned Sessions Judge partly allowed the respondent-husband's Appeal and reduced the amount of maintenance from Rs.10,000/- to Rs.4,000/-. The parties to this application are litigating since 2007. In a civil proceeding, the respondent-husband was directed to pay maintenance amount of Rs.7,000/- per month to the applicantwife. In addition to this, the above referred order was passed. Waghmare 1/2

10 Revn-329-14.doc Thus, the respondent-husband is under obligation to pay Rs.11,000/- per month. In addition to this, the wife's Petition filed under the Protection of Women from Domestic Violence Act is pending.

In order to put an end to this application, I would like to pass the following order which would meet the ends of the justice :- The respondent-husband shall clear the entire arrears within 8 weeks from today. If such arrears are not cleared, as directed above, his defence in the Domestic Violence case shall stand struck of and the learned Magistrate shall decide the Petition as soon as possible.
