By an order dated 27.9.2016 the applicant was granted interim relief. The reasons for granting interim relief are mentioned in the said order dated 27.9.2016. 2.
The record reveals that co accused namely Amol Gawade brother of the present applicant was arrested by the police on 15.8.2016. He was custodially interrogated and now has been released on bail on 6.10.2016. It appears from the record of investigation that in his custodial interrogation, necessary and relevant information pertaining to the present crime and about the two absconding accused persons has been revealed. Prima facie, it appears that the applicant has not taken any active part in the assult. In view thereof according to me the custodial interrogation of the applicant is not necessary.
2 /2ABA-1662-16-16 Interim relief granted by an order dated 27.9.2016 is hereby confirmed.

Application is allowed in the aforesaid terms. However, the applicant is directed to attend the Investigation Officer as and when called for between 10.00 a.m. to 12.00 noon till filing of the charge sheet. 4.
It is needless to mention that before calling the applicant to the police station the Investigating Officer shall issue a notice under Section 160 of the Cr.P.C. 5.
