Learned A.P.P. has verifed the statement of the applicant to the effect that he has settled with 8 investors, whose names fnd mention in the F.I.R.

2/3 14 ABA-2641-22 (C).doc Other investors, being 12 in number, have fled their interim application bearing No.3423 of 2022 and they seek intervention in the present application. Learned counsel for the intervenors submits that they have invested an amount of Rs.69,00,000/- collectively and unless and until their accounts are not settled, the applicant shall not be released in the event of his arrest.

The learned A.P.P. does not dispute that 8 investors whose names fnd place in the F.I.R. are settled. Though there are other investors, learned counsel for the applicant states that he shall verify the claims and make every possible endeavour to effect settlement with them also. In the wake of the above statement, though this Court has refrained from issuing any mandatory direction to settle with the intervenors, on being satisfed that the investors whose names are mentioned in the application are already settled, the applicant deserve protection from arrest. As far as the intervenors are concerned, their fate shall depend upon the proceedings under the MPID Act, which are already instituted.

: ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.139 of 2022 registered with Dombivali Police Station, applicant-Anand Harshad Dani shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount.

3/3 14 ABA-2641-22 (C).doc (c) The applicant shall report to the concerned police station from 17th October, 2022 to 20th October, 2022 between 3.00 p.m. to 5.00 p.m. and, thereafter, as and when called for, when the intervenors are also at liberty to remain present and apprise the applicant about their claim and the applicant shall make every endeavour to settle their claim.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Offcer and shall not tamper with evidence.

In view of the disposal of the application, interim applications do not survive and stand disposed off. ( SMT. BHARATI DANGRE, J.)
