2 November, 2017.
P.C. :- Affidavit tendered by Mr. Yagnik is taken on record. 2.
Pursuant to this Petition and the earlier order, the Petitioner, father of the minor girl Tanvi, has since succeeded in obtaining her custody. The minor girl was traced at Pune. She was removed from the custody of the parents by a boy and against whom a crime is registered. Mr. Yagnik states that the two Sections, one under the Protection of Children from Sexual Offences Act, 2012
906. WP 3689.17.doc (for short POCSO) and Section 375 of Indian Penal Code have been added. The minor girl was handed over to the Petitioner through and by the intervention of the Child Welfare Committee. The minor girl is present in Court.
3.
She claims that she is residing with her father at Bandra - Mumbai. This fact is confirmed even by the Petitioner. 4.
Since the child is restored back to her parents and is in their custody, we dispose of this Petition but by clarifying that the Court has not expressed any opinion as far as the merits of the charges of the Criminal case.
