Heard learned counsel for the Petitioner. The learned counsel for the Petitioner submits that by this Writ Petition they are challenging the order dated 8th July, 2011 passed by the Joint Civil Judge Junior Division, Alibaug below application Exhibit 96 in Regular Civil Suit No. 104 of 2000. He submits that during the pendency of the present proceeding, Suit stands disposed of as the dispute is settled out of the Court. He submits that in view of this, he have received instructions to withdraw the Writ Petition. To that effect he has given in writing. Same is taken on record. The same is accepted.
