Heard learned Counsel for the applicant and the learned APP for the State.

The applicant has been convicted under Section 302 of IPC. The applicant is seeking bail on medical ground of his mother. It is stated that the mother of the applicant is suffering from hypertension and diabetes. She is also suffering from Cerebrovencular accident resulting in weakness in left side of the body (Hemiporesis) since one year. It is seen that the elder

sister of the applicant is staying with their mother. In such case it is possible for her to take care of of the mother and on this ground of medical illness of the mother, we are not inclined to grant bail to the applicant.

The second prayer of the applicant is that if bail is not granted, his appeal may be expedited. Looking to the facts and circumstances of the case, we expedite the hearing of the appeal. As soon as the paper-book is ready, the appeal to be placed on final hearing board.
