Heard learned Counsel for the parties.

This application is for bringing legal heirs on record of deceased appellant no.1B Netaji Rajaram Shewale who died on 05.05.2014.

The learned Counsel for the respondent submits that they have no objection if the Civil Application is allowed.

Considering the submissions made by learned counsel for the applicant and averments made in civil application, I am satisfied that applicant has made out the case for allowing the civil application. Hence, the following order is passed:

a) Delay in preferring the Civil Application is condoned.

15 cas 1679-14=.doc b) Applicant is permitted to bring legal heirs on record of deceased appellant no.1b in Second Appeal as well as Civil Application if any within four weeks from today, failing which civil application shall stand dismissed without referring back to the court .

c) If amendment is carried out within stipulated time as stated herein above, applicant is directed to serve the amended copy of Second Appeal memo on respondent or their Advocate thereafter immediately.

d) Civil Application stands disposed of accordingly.
