The Appeal filed by the appellant had just now been summarily dismissed by me. The learned counsel for the appellant prays, by the present application, that at least the direction to compensate the accused as given to the appellant by the trial Judge be set aside.

I find that the compensation ordered is only of an amount of Rs.1,000/-. The trial Judge had discretion to award the said compensation. I do not see any error or illegality in the order imposing compensation. I have already observed that there was no merit in the appeal against acquittal.

In the circumstances, the relief of cancelling the order directing compensation, as prayed for, cannot be granted to the appellant.

The application is rejected.
