This Application is preferred by the plaintiff for condonation of 11 days delay in filing First Appeal challenging the judgment and decree dated 02.08.2013 passed by the Bombay City Civil Court, at Dindoshi in S.C. Suit No. 243 of 2012.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

i) Civil Application is allowed in terms of prayer clause (a) which read thus :
