DATE : 2nd DECEMBER, 2021 P.C:- By this interim application, the applicant seeks amendment in the writ petition in terms of the schedule appended at Ex.A to the interim application.

We have heard the learned counsel for the parties. A perusal of the interim application indicates that by an order dated 9th March, 2020 passed by this Court, this Court had directed the respondent no.1 to

2/3 take a decision in the controversy in the present proceedings of the redesignating as an Associate Professor in terms of the policy of All India Council for Technical Education.

Pursuant to the said order dated 9th March, 2020, the respondent no.1 passed an order granting part relief to the petitioner and rejecting part of the relief in the petition.

The petitioner still seeks part of the relief prayed in prayer clause (a) of the writ petition and seeks further relief necessitated in view of the further order passed by the respondent no.1 pursuant to the interim order passed by this Court on 9th March, 2020. 5.

We accordingly allow the applicant to carry out the amendment as prayed. Interim application is allowed in terms of the prayer clause (a). Amendment to be carried out within two weeks from today. Amended copy of the petition shall be served upon the respondents within one week from the date of carrying out the amendment. It is made clear that merely because the amendment is permitted, none of the respondents have deemed to have admitted any of the averments

3/3 made in the amendment and also the contentions raised. All contentions on factual aspects as well as law are kept open. 6.

The respondents shall file affidavit in reply to the amended copy of the petition within four weeks from the date of service of the amended copy of the petition with a copy to be served upon the petitioner's advocate simultaneously. Rejoinder, if any, to be filed within one week thereafter.
