IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION PUBLIC INTEREST LITIGATION NO. 02 OF 2019 Vineet Dhanda ...

Petitioner vs.

The State of Maharashtra & Ors.

...

Respondents None for the petitioner.

Ms. Nisha Mehra, AGP for respondent nos. 1 to 3, 5 and 6.

CORAM:

PRADEEP NANDRAJOG, C.J. & N.M. JAMDAR, J.

DATED:

17th June, 2019 P.C. :

Though none appears for the petitioner but since the Petition purports to espouse a public cause, we have perused the Petition. 2.

Referring to newspaper reports, the facts pleaded in the Petition are that the drivers of heavy commercial vehicles do not abide by the rules requiring them to ply the vehicles on the left side of the carriage way connecting the city of Mumbai and the city of Pune. As a result of this undisciplined driving, accident occurs. Traffic jams also result.

5.PIL2_2019.doc 3.

Prayer made in the Writ Petition is to direct the respondents to take action against the drivers of the commercial heavy vehicles. 4.

In the Public Interest Litigation, it is pleaded that the drivers who violate the lane driving norms are detected and penalized. Thus, it is apparent that the authorities concerned are taking action against the errant drivers and hence no mandamus need be issued. 5.

Public Interest Litigation is dismissed.
