Heard learned counsel for the petitioner. Petitioner herein is challenging the order passed by MPID Court directing the petitioner to deposit an amount of 60.10 lacs within 2 weeks time, failing which the vehicles would be transferred in favour of highest bidders. It is a matter of record that petitioner is still in custody. The bail application filed by petitioner is pending is likely to be heard on 07/10/2015.

2) Learned counsel for the petitioner, upon instructions seeks liberty to withdraw the petition with further liberty to approach MPID Court and file an application seeking extension of time to deposit an amount of 60.10 lacs or get higher bids in respect of said vehicles. Learned counsel for the petitioner submits that petitioner has bonafide intention to deposit amount of Rs. 60.10

2 906.3888.15 wp lacs, however, petitioner has expressed his inability on account of his being in custody.

3) Liberty as prayed for is granted in the interest of justice. Learned Magistrate shall consider the application on its own merits without being influenced by the withdrawal of this petition.
